Necessity of industrial facility labor conditions certification
The necessity to carry out the procedure of industrial facility labor conditions certification is stipulated by the Labour Code of the Republic of Kazakhstan Article 183, Order of the Minister of Health and Social Development of the Republic of Kazakhstan dated 28 December 2015 No 1057 ‘On Approval of the Rules of mandatory periodic certification of production facilities in terms of working conditions’ (hereinafter - the Rules) (amendments to Order of the Minister of Labour and Social Protection of the Republic of Kazakhstan dated 7 November 2017 No 374 ‘On Amendments to the Order of the Minister of Health and Social Development of the Republic of Kazakhstan dated 28 December 2015 No 1057 “On Approval of the Rules of Mandatory Periodic Certification of Production Facilities for Working Conditions”), as well as regulatory documents of the Ministry of Health of the Republic of Kazakhstan.
It is important to note the fact that the procedure of industrial facility labor conditions certification is a mandatory procedure aimed at assessing the actual state of the factors of the production environment at each workplace in order to inform the employee, the employer, as well as to develop and take measures to improve and enhance the working conditions of each person. Professional certification will not only minimise the risk of occupational injuries, but will also reduce the likelihood of occupational diseases.
ECOEXPERT LLP carries out the procedure of industrial facility labor conditions certification by means of inspection of workplaces and instrumental measurements of all existing physical, chemical and psychophysiological production factors of labour. Measurements are carried out with the most advanced instruments and equipment included in the unified register of measuring instruments of the Republic of Kazakhstan.
Procedure for workplaces certification (in practice):
Step 1: After selecting the certification organisation and concluding the relevant agreement with it, an Attestation Committee is formed consisting of a chairman, members and a secretary responsible for compiling, maintaining and storing documentation on certification of production facilities for labour conditions. The Attestation Committee of the organization includes the head or his/her deputy, specialists of occupational health and safety services and structural subdivisions of the organization as agreed, as well as representatives of employees.
Step 2. The certification company analyses the list of certified workplaces and requests from the certified organisation so-called ‘initial data’, which, as a rule, includes information on: the benefits and compensations provided to employees (additional payments, additional leave, milk and/or preventive medical nutrition, reduced working hours/week); the organisation of briefings and training in occupational health and safety, electrical safety; the provision of employees with personal protective equipment; the organisation of primary and periodic medical examinations; gender and age composition of the personnel; labour and rest regime (including shift patterns, regulated breaks, etc.); accidents that have occurred.
Step 3: Instrumental measurements and assessments of the levels of harmful production factors at workplaces (for example: chemical factor, microclimate parameters, light environment, noise level, vibration, assessment of the severity, intensity of the labour process, injury hazard of workplaces, etc.).
Step 4. Materials of workplace certification on labour conditions are prepared (in form and content in accordance with the requirements of the current Rules) and submitted for review to the members of the commission - representatives of the organisation being certified.
Step 5: If necessary, based on the results of review of the report documents by the commission members - representatives of the certification company, clarifications are made in the certification materials, after which the certification of workplaces is completed and information on its results is submitted to the Authorised State Labour Authority (Local Executive Body - Labour Inspectorate): The certification company - in the approved form (Annexes No7 of the Rules in force), in turn, the certified company - in the approved form (Annexes No8-12 of the Rules in force).
Step 6. Upon completion of the certification of workplaces in terms of working conditions, the employer, in accordance with Article 182 of the Labour Code of the Republic of Kazakhstan, is obliged to inform its employees of the results of the certification process.
Each workplace must be certified at least once every five years, irrespective of the employer's form of ownership and the complexity of workplaces.
